TO REDUCE OR NOT TO REDUCE FUEL PRICES; HIGH COURT TO RULE ON WEDNESDAY (26TH OCTOBER 2011)

An Accra High Court (Cocoa Affairs, Court 11) presided over by His Lordship Patrick Baayeh will on Wednesday, 26th October 2011, give its verdict on whether or not the prices of diesel, petrol, LPG and other petroleum products currently being charged consumers should be reduced.

On Wednesday, the court will either uphold or abolish the controversial ex-refinery differential imposed on fuel prices in the country since 6th June 2009. After the court’s ruling, the National Petroleum Authority will also know whether they can get away with the GH˘661 million they have so far collected from the imposition of the ex-refinery differential or whether they have to pay it into the Consolidated Fund.

These are the issues being tested by Development Data, a consumer protection and policy research organisation, Mr Kwaku Kwarteng an aspiring parliamentary candidate of Obuasi and Mr Abdul Ganiyu of Tamale.

In a writ filed in the Accra High Court in September 2009 against the National Petroleum Authority and the Tema Oil Refinery, the three plaintiffs are praying the court to rule on matters that will permanently shape Ghana’s petroleum pricing policies.


On 5th July 2010, judgement in default of appearance was given against the
defendants after they failed to enter appearance for the case. But the court later set aside its judgement following a plea by the defendants for a second opportunity to
argue their case.

On Wednesday, 26th October 2011 at 9.00 am, the High Court (Cocoa Affairs, Court
11) will give its final verdict in this landmark case.
